Summary
The Aggrieved’s employment was terminated by the University on grounds of “Unauthorised Absence” and she sought the representation of the Union in this matter.
The University contended that they had just cause for the dismissal of the Aggrieved as her vacation leave, departmental leave and other absences from work were not authorised by her supervisor.
The Union contended that her vacation leave was authorised and that the continuation of the disciplinary hearing to have the Aggrieved dismissed was against due process and natural justice.
The IDT found that the vacation leave of the Aggrieved was authorised but her departmental leave was not. It was further found that the process and procedures followed by the University to dismiss the worker infringed on the Aggrieved’s right to due process under natural justice.
The IDT ordered her reinstatement and payment of full wages.
